Entering national phase of PCT applications

Patent applicants who wish to protect their invention in more than one country should first file a national or regional patent application with their national or regional patent Office, and within 12 months from the filing date of that first application, they file their international application under the PCT.

The deadline for entering the Ukrainian national phase is 31 months from the priority date. International application is prosecuted in Ukrainian language.

Ukrainian applications undergo substantive examination which should be requested within 3 years from the international filing date with the examination fee paid.

If the substantive examination goes smoothly and the applied invention meets all the patentability requirements, the decision of protection is issued.

The registration and publication fees should be paid within 3 months from the date of receipt of the decision. After that, the patent is issued.

A patent for invention in Ukraine is valid for 20 years from the filing date.

The above-mentioned actions are taken by a local representative- a patent attorney of Ukraine. Legalization or notarization of Power of Attorney are not required.
